Terms of Use
These terms are an agreement between you and the provider of OZRK Fit. Please read them. If you do not agree, do not use the app.
1. Who we are and what you are agreeing to
OZRK Fit (the “App”) is an iPhone app for logging and planning workouts and runs, logging food, viewing recovery and progress information, and related features. It is provided by OZRK LLC, PO Box 283, Greenland, AR 72737 (“we”, “us”). Support: ozrkapp@gmail.com.
By tapping “Agree and continue”, creating an account, or using the App, you agree to these Terms and to our Privacy Policy. The App asks for your agreement when you first use it and again whenever we publish a new version of either document. If you do not agree, you cannot use the App.
You also agree to the Apple Standard End User License Agreement only to the extent a section below does not already cover the same subject; see section 16 for the terms Apple requires.
2. Who may use the App
You must be at least 13 years old to use the App, and old enough in your country to enter a binding agreement, or have a parent or guardian agree on your behalf where the law of your location requires it. The App is not directed to children under 13. When you accept these Terms and when you create an account, the App asks you to confirm that you are at least 13 years old. That is a confirmation, not a check: the App does not verify your age with identification. If you tell us (or we learn) that you are under 13, your account is restricted so that it can no longer be used, and nothing is deleted unless you ask us to delete it or we have a reviewed process that requires it. You can delete your account at any time (see section 4 and the Privacy Policy).
3. What OZRK Fit is — and is not
OZRK Fit is a fitness and wellness tool. It is not medical care and does not diagnose, treat, cure or prevent any condition. Workout plans, “readiness” and recovery indicators, nutrition numbers, charts and any other output are general information and estimates based on what you enter or choose to share.
Talk to a qualified healthcare professional before starting or changing an exercise or nutrition program, especially if you have a medical condition, an injury, are pregnant, take medication, or have a history of disordered eating. Stop exercising and seek medical help if you feel unwell, dizzy, or in pain. Never ignore professional advice because of something in the App.
Injuries, limitations and clinician restrictions you enter are used to choose exercises more cautiously. The App cannot guarantee that any exercise, pace, load or diet is safe for you. You are responsible for deciding what is appropriate for your body and surroundings, including when running outdoors (traffic, weather, daylight and terrain).
BMI is a screening number from height and weight; for adults it is compared with published CDC categories. It does not measure body fat or health and is not a diagnosis. It is shown only for adults (20 and over); for younger people it is not calculated.
Food data. Product and food information comes from third-party sources (Open Food Facts, which is crowd-sourced, and, where switched on, USDA FoodData Central) and can be wrong, incomplete or out of date. Generic food values describe a type of food, not a particular brand. Always check the package, especially for allergens.
Reminders and widgets are conveniences, not alarms or safety systems. iOS decides when notifications and widgets update, and Focus modes, Low Power Mode or your settings can delay or silence them. Do not rely on them for anything time-critical or medical.
4. Accounts and account deletion
You can use many features without an account; that data then stays on your device. To back up and sync your records you can create an account with your name, email address and a password. You must give accurate information, keep your password confidential, verify your email address, and tell us promptly about unauthorized use. You are responsible for activity under your account.
Deleting your account. You can delete your account in the App (Profile › Data & account; you will be asked to re-enter your password and to type DELETE) or by emailing us as described on the support page. Deleting your account removes your account and the records tied to it from our cloud service and clears the App’s data on your device. It cannot be undone. Deletion does not cancel an App Store subscription, and it does not remove copies that other companies hold under their own policies, or copies that remain in backups and logs for a limited time (see the Privacy Policy).
5. Your content and the license you give us
You keep ownership of what you enter or upload (for example workouts, runs, food logs, notes, measurements and progress photos). You give us a limited, non-exclusive license to store, process and transmit that content only as needed to provide the App to you — for example saving it to your account, syncing it between your devices, producing a photo-based food estimate you requested, and exporting it back to you. We do not sell your content or use it to advertise to you.
Only upload or photograph things you have the right to use. Do not include other people’s private information in photos you submit.
6. Food, nutrition, recovery and photo features
- Calorie, macronutrient, sleep, recovery and “readiness” figures are estimates or summaries of what you enter or share. They can be wrong and are not a measure of your health.
- Product and barcode lookups use third-party data (for example Open Food Facts, which is crowd-sourced). It can be incomplete, outdated or wrong. Always read the package, especially for allergies. A missing warning does not mean a product is safe for you.
- Photo-based estimates, where the App offers them (currently a Premium feature that may not be available in every version), send a photo you choose, once, to our server and on to an AI model provider to produce approximate calories and macronutrients. Estimates are approximate, can miss hidden ingredients and are never a substitute for a nutrition label or professional advice. You review and can change every value before anything is saved. Where offered, you can choose to keep the photo with the meal: it is then deleted automatically 7 days after upload, while the food entries you confirmed remain. Food database values (USDA FoodData Central) are averages from public data and may not match the exact food you ate. Reading nutrition labels or ingredient lists from photos is not available today.
- Premium features have usage limits that may change.
- Weather, daylight and outdoor notes come from a third-party weather data service and are informational only; check local conditions and official warnings yourself.
7. Subscriptions and purchases
Availability. We may offer an auto-renewing “OZRK Fit Premium” subscription through the Apple App Store. This section applies only where, and from the time, a subscription is actually offered in the App. Whether a subscription or free trial is offered, and at what price, is shown by Apple on the purchase sheet before you confirm; that is the price and trial you agree to.
- Payment and renewal. Where offered, payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling. Manage or cancel in your device’s Settings › [your name] › Subscriptions. Deleting the App or your OZRK Fit account does not cancel an App Store subscription.
- Free trials. If an offer includes a free trial, you can cancel before it ends to avoid being charged; any unused part of a trial ends when you purchase a subscription. Eligibility for a trial is determined by Apple.
- Refunds. Purchases are processed by Apple, so refund requests are handled by Apple under its policies (reportaproblem.apple.com). We cannot issue refunds for App Store purchases ourselves.
- Verification. To unlock Premium features that run on our server, the App sends Apple’s signed transaction to our server, which verifies it with Apple and records whether your account has an active Premium entitlement and when it expires. We do not receive your payment card details.
- Changes. Prices and plans can change; Apple will tell you about price changes and ask for your consent where required.
8. Acceptable use
Do not: use the App unlawfully; access or try to access another person’s data or accounts; interfere with or circumvent security, usage limits or Premium entitlements; reverse engineer, decompile or copy the App except as the law allows despite this restriction; use automated means to scrape or overload our services or the third-party services the App uses; or upload content that is unlawful, infringing or harmful.
9. Third-party services
The App depends on third parties, each with its own terms: Apple (App Store, StoreKit, Apple Health, device location services), Supabase (account sign-in, database and file storage), an AI model provider that processes photos you submit for estimates (currently Anthropic, through our server), Open-Meteo (weather and place search) and Open Food Facts (product data, licensed under the Open Database License). We are not responsible for third-party services, and they may be unavailable or change.
10. Our intellectual property
The App, its software, design, text, graphics and the OZRK Fit name and logo belong to us or our licensors and are protected by law. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for your own personal, non-commercial use, subject to these Terms and the Apple Media Services rules. Product data from Open Food Facts remains subject to its own license. If you send us feedback, you allow us to use it without obligation to you.
11. Availability and changes to the App
We may change, suspend or discontinue features (including Premium features) and we do not guarantee that the App or any server feature will be uninterrupted, error-free or available in your region. Limits on photo analysis or other Premium features may change. Features that depend on your device (GPS, motion, Apple Health) depend on your device’s hardware, settings and permissions, which you control in iOS Settings.
12. Ending your use
You may stop using the App at any time. We may suspend or end your access if you materially breach these Terms or misuse the service, or if we stop providing the App. Sections that by their nature should survive (for example ownership, disclaimers, limits of liability) survive ending these Terms. Ending your use does not cancel an App Store subscription.
13. Disclaimers
To the extent permitted by law, the App and all content are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. Estimates, plans and readiness or recovery information may be inaccurate. Nothing in these Terms excludes rights you have under consumer law that cannot be excluded.
14. Limitation of liability and indemnity
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the App; and our total liability for any claim relating to the App is limited to the greater of the amount you paid us for the App in the 12 months before the claim and US$50. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or willful misconduct.
Exercise and nutrition carry inherent risk. You use the App’s exercise, running and nutrition information at your own risk.
To the extent permitted by law, you agree to indemnify us against third-party claims arising from content you submit in breach of these Terms or your unlawful use of the App. This does not apply where the law does not allow it, including to consumers in places that prohibit such clauses.
15. Governing law and disputes
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules, except where your local consumer law gives you the right to rely on the law of the place where you live. Please contact us first at ozrkapp@gmail.com so we can try to resolve a concern informally. Any dispute we cannot resolve informally will be brought in the state and federal courts located in Washington County, Arkansas, unless mandatory law gives you the right to bring it elsewhere. Nothing in these Terms waives rights that cannot be waived.
16. Terms required by Apple
If you use the App on an Apple device, you acknowledge that:
- These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its content, maintenance and support, and any warranty or product claims.
- Our license to you is limited to a non-transferable license to use the App on Apple-branded products you own or control, as permitted by the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to an applicable warranty, you may notify Apple, which will refund the purchase price (if any) of the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claim, loss, liability, damage or cost attributable to a failure to conform to a warranty is our responsibility.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your possession and use of it — including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer-protection or privacy claims.
- If a third party claims that the App infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms (for example your wireless data service agreement) when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and on your acceptance Apple will have the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- Contact for questions, complaints or claims: OZRK LLC, PO Box 283, Greenland, AR 72737, ozrkapp@gmail.com.
17. Changes to these Terms
We may update these Terms. Each published version has a version label shown at the top of this page. When a new version is published, the App asks you to review and accept it before you keep using the App; if you do not accept, you cannot continue to use it. The version you accepted and the time of acceptance are stored on your device. Changes apply going forward and do not affect your rights for past use.
